TERMS AND CONDITIONS
Please ensure you have read the below terms and conditions upon booking a session with me. By completing a booking, you confirm that you have read, understood, and agree to all of the terms and conditions as outlined below:
1. Payment and Cancellation
The client’s session payment secures their booking and is non-refundable. If the client is unable to attend their session, payment can be transferred to one rescheduled session. The client must notify the photographer at least 48 hours before the session to reschedule, or no later than 12 hours before for illness or injury.
Failure to notify the photographer within these timeframes will result in forfeiture of the session fee.
If the photographer needs to cancel or reschedule the session, the client may transfer their payment to a rescheduled session or request a refund.
In the event of poor weather, the photographer will decide on the day if the session can proceed and, if necessary, arrange a mutually agreed postponement date.
2. Change of date or time
If the client requests to change their session time/date, the photographer will try to accommodate this but cannot guarantee availability particularly for mini sessions. The client may request one complimentary date or time change, subject to the photographer's availability.
3. Digital images
Images provided in the client’s online gallery are the photographer’s final work. Should the client request any additional changes or alterations, this will incur additional charges. The client is not permitted to make any alterations to their images when posting on social media, including (but not limited to): applying filters, black and white, cropping and retouching. The photographer requests that the client refrains from posting any screenshot of images to social media as this greatly reduces the quality of the images and does not reflect the photographer's original work. Where the photographer does not retain the images for the purpose of use on social media or website, images will be deleted 30 days after the client has received their gallery, and retrieval will not be possible. Clients must download and back up their images within this timeframe. Therefore, the client is encouraged to download and backup their images in a second, secure digital location. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond the photographer's control. Images are for the personal use of the client only. If any 3rd party wishes to use these images for commercial purposes, the photographer must be consulted and permission will be at the photographer's discretion. COPYRIGHT of images is owned by True Focus Photography. The client is permitted to print and share images for their own personal use. The client does not have the right to revoke this consent. If the client wishes not to have their images used on social media please indicate this to the photographer via email correspondence PRIOR to their session.
4. Failure to perform
If, in the unlikely event the photographer cannot perform any agreed services due to any cause beyond photographer's control including weather, illness, vehicle breakdown, camera or computer malfunction, data corruption, accidental deletion, unforeseen circumstances (including acts of God), the photographer will refund any monies paid; however, the photographer shall have no further liability.
5. Conduct
The client understands that at True Focus Photography, we strive to create a respectful and positive experience for all clients. We kindly ask that clients, their family, and guests conduct themselves with courtesy during the session.
The following behaviors will not be tolerated:
Illegal activities or intentions
Bullying, harassment, or abusive language
Verbal or physical aggression toward the photographer or others
Actions that damage or threaten the photographer's equipment or reputation
If such behaviors occur, the photographer reserves the right to terminate the session immediately. This will be considered a breach of contract, and no refunds will be issued.
In the rare event of ongoing unreasonable or abusive behavior, True Focus Photography may terminate the client relationship permanently and without further obligation.
6. Cameras and picture taking during the session
The client understands that: No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer in writing.
7. Home sessions
The client understands that: Home lifestyle sessions require a suitable environment in which to photograph in. Light is the most important aspect of our photography, and therefore the environment must be bright and light with big windows. The client must follow all instructions provided in the session preparation guide to ensure optimal results. Failure to do so may impact the quality of the images and could result in the need for rescheduling, which may incur additional fees. The photographer will bring all necessary equipment to achieve optimal results.
8. Re-shoots / refunds
The client understands that: Re-shoot requests may be granted, at the discretion of the photographer, should the client be unhappy with their gallery. If a re-shoot is requested and granted by the photographer, the previous session’s gallery will be deleted. The client will not be able to access the images from the previous gallery, and will be provided with a new gallery from the re-shoot. Should the client want to choose images from both the previous session and the re-shoot session, the client agrees to an additional session fee for the re-shoot session. The re-shoot will in this case be deemed a separate shoot, and charged with an additional session fee. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. We are committed to working with clients to address concerns, though re-shoots or refunds are not guaranteed.
